General Terms and Conditions
Last updated: October 27, 2026
This is a convenience translation. The German version prevails. The legally binding version is the German Allgemeine Geschäftsbedingungen (AGB).
§ 1 Scope
(1) These Terms apply to all contracts for the use of Doneforyou (doneforyou.io, app.doneforyou.io) between WHITEACADEMY Birger Weiß, owner Birger Weiß, Zur alten Ziegelei 10a, 48607 Ochtrup, Germany (“Provider”, “we”) and the customer (“Agency”, “you”).
(2) Businesses only: Doneforyou is offered exclusively to businesses (Unternehmer) within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law. We do not enter into contracts with consumers within the meaning of Section 13 BGB. When registering, you expressly confirm that you are acting as a business, i.e. that you use Doneforyou for your commercial or independent professional activity; we store this confirmation with the date and time. Provisions that apply only to consumer contracts, in particular the statutory right of withdrawal (Sections 312g, 355 BGB), do not apply.
(3) Deviating terms of the Agency apply only if we expressly agree to them in text form.
(4) The Data Processing Agreement (AVV, in German) forms part of these Terms.
§ 2 Services
(1) Doneforyou is software provided over the internet (software as a service). With it, agencies can in particular manage clients and recruiting campaigns, collect onboarding information from their clients, create ad copy, ad images and job application landing pages using artificial intelligence, receive and manage applications, send automated messages to applicants, chat with applicants via a dedicated WhatsApp number per client (add-on service, § 4(4)) and provide their clients with an applicant portal. Agencies can also have existing funnels of other providers read via a link in order to use them in a campaign or save them as a private copy in the “Inspiration” area (import, § 9(4)).
(2) Which features and limits apply (e.g. number of clients and campaigns, AI credits) depends on the booked plan and the service description shown at the time of booking. Features marked “Soon” are not yet part of the service.
(3) We owe the provision of the software, but not any particular result, in particular not any particular number or quality of applications or hires. The Agency runs ads itself through its own ad account, e.g. with Meta; the Agency bears the costs of ad budgets.
(4) We continuously develop Doneforyou and may change features as long as the contractually agreed core of the service is preserved and the change is reasonable for the Agency.
§ 3 Conclusion of contract and account
(1) The contract for the free Starter plan is concluded when you complete your registration. You book paid plans, additional credits and add-on services such as WhatsApp numbers in the app (ordering process under paragraphs 2 to 4).
(2) Ordering process: In the app, you choose a plan with a term, additional credits or a WhatsApp number and review the summary (service, term, renewal and cancellation, net price, VAT, total), your billing address and the payment method. You can correct input errors at any time until you submit the order: the billing address via “Ändern” (change), the selection via “Zurück” (back). Before submitting, you expressly confirm that you are ordering as a business for the company stated (§ 1(2)), that you accept these Terms and conclude the Data Processing Agreement, and the term and renewal of the chosen service; without these confirmations, no order is possible.
(3) By clicking “Zahlungspflichtig bestellen” (order with obligation to pay), you make a binding offer. The contract is concluded as soon as our payment service provider confirms the payment; with SEPA direct debit this may take a few days. You order an upgrade to a larger plan in the app with “Jetzt kostenpflichtig wechseln” (switch now with obligation to pay); it takes effect when the payment is confirmed. You order a switch to a smaller plan with “Wechsel planen” (schedule switch); we accept it when you submit it, and it takes effect at the end of the current term (§ 6(5)).
(4) We confirm receipt of your order by email without undue delay. The email contains the order confirmation, your confirmations from the ordering process and these Terms, the Data Processing Agreement and the Privacy Policy in the version you agreed to, each as a PDF. We store the contract text; you can access it at any time in the app under Settings → Invoices → Orders. The language of the contract is German. We are not subject to any code of conduct.
(5) The information you provide when registering and in your account must be correct and complete. Login credentials must be kept secret. If you suspect that third parties know your login credentials, change your password and inform us.
(6) Accounts that you create for your clients for the applicant portal are used by your clients on your behalf. You are responsible to us for their use.
§ 4 Plans, AI credits and add-on services
(1) The Starter plan is free of charge and includes a one-time starting balance of AI credits. The Pro and Ultra plans include a new balance of AI credits every month. This also applies to a twelve-month term. The new monthly balance is credited as soon as the fee for the current billing period has been paid.
(2) AI generations (e.g. landing page, ad copy, ad image and change requests) consume AI credits. The app shows how many credits an action costs before it starts. If a generation fails for technical reasons, we credit the credits back. Text messages (SMS) to applicants (from the Pro plan) consume 25 AI credits per SMS part; if the balance is insufficient, the message is not sent. Additional credits can be purchased with a paid plan (Pro, Ultra).
(3) Unused credits from the monthly balance expire at the beginning of the next billing month and are not carried over. If a paid plan ends, the remaining monthly balance expires. Additionally purchased credits do not expire as long as your account exists. Credits are not transferable and are not paid out.
(4) WhatsApp per client: From the Pro plan onward, you can add a WhatsApp number for each client. We provide a dedicated WhatsApp number for this and activate it, usually within 1–3 business days. The number remains ours; neither you nor your client has any claim to a specific number or area code, to its transfer or to its continued use after the contract ends. It costs EUR 19 net per number per month and is a separate contract alongside your plan. Billing starts at booking, even while the number is still being set up. The minimum term is three months from booking; thereafter the contract renews for one further month at a time. You can cancel WhatsApp for each client individually in the app (WhatsApp → client → Manage) or in text form at the end of a paid month, at the earliest at the end of the minimum term, and withdraw the cancellation until then. The app shows the earliest date on which a cancellation takes effect.
(5) Messages within 24 hours of an applicant's last message are included in the price. Outside this window, WhatsApp only permits templates approved by WhatsApp. Each template message sent consumes 10 AI credits from your balance, even if it is sent automatically or by your client in the applicant portal; if the balance is insufficient, it is not sent. The app shows the cost when you select a template.
(6) If you switch to the Starter plan or your paid plan ends, WhatsApp for your clients ends at the next possible date under paragraph 4. If you delete a client, WhatsApp ends for that client immediately; the fee remains payable until the end of the minimum term or the current month, after which the contract ends without notice of cancellation. If you delete your account, all WhatsApp contracts end immediately. Amounts already paid are not refunded pro rata. After the end, we release the number; the chats remain readable until the application, the client or your account is deleted.
(7) WhatsApp is a Meta service. Meta decides whether a number is registered, which templates are approved and how many recipients can be reached. If Meta restricts or blocks a number or a WhatsApp Business account, in particular due to a violation of WhatsApp's rules, we are not responsible for this. In the event of a complete block through no fault of your own, you may cancel the affected number with immediate effect.
§ 5 Prices and payment
(1) The prices shown at the time of booking apply. All prices are net plus statutory VAT.
(2) The fee is payable in advance for the respective billing period. Payment is processed by our payment provider Stripe; you authorize us to collect the amounts using the stored payment method. When booking, you provide your billing address and, if available, your VAT ID. For businesses in another EU member state with a valid VAT ID, the reverse-charge procedure applies. You receive invoices electronically; you can also find them in the app under Settings.
(3) If a payment fails, your plan initially remains active. You are asked by email and in the app to check your payment details, and the payment is retried several times. If the attempts remain unsuccessful, the paid plan ends and your account is switched to the free Starter plan. Your data is retained. Our claim to the outstanding fee remains unaffected.
(4) We may adjust prices with at least six weeks' notice effective from the start of a new billing period. Price increases do not apply to a fixed term already in progress. If you do not agree to an increase, you may cancel until it takes effect; we will point this out in the notice.
§ 6 Term and cancellation
(1) You book paid plans with a monthly term. Where offered at booking, you can instead choose a twelve-month term; in return you receive a discount, the amount and payment method of which are shown at booking.
(2) Monthly term: The contract runs for one month and renews for a further month at a time unless cancelled by the end of the current term.
(3) Twelve-month term: The contract runs for twelve months and renews for a further twelve months at a time unless cancelled with three months' notice to the end of the current term. Early ordinary cancellation is excluded. If a cancellation is received later, it takes effect at the end of the following term; before you cancel, the app shows you the date on which the cancellation takes effect.
(4) You can cancel using the “Cancel contract” button in the app (Settings) or at doneforyou.io/kuendigen, or in text form (e.g. by email to [email protected]). For a monthly term, the cancellation takes effect at the end of the paid month; for a twelve-month term, in accordance with paragraph 3. You can withdraw a cancellation in the app until it takes effect. Your account is then switched to the free Starter plan unless you cancel the entire account; purchased additional credits are retained.
(5) Upgrading to a larger plan is possible at any time and takes effect immediately. The price difference for the current billing period is calculated pro rata and invoiced immediately. AI credits are granted pro rata as well: immediately the difference to the new plan's monthly balance for the rest of the current credit month, and the new plan's full monthly balance from the next credit month. The app shows the number before you switch. Downgrading to a smaller plan or switching from a twelve-month to a monthly term takes effect at the end of the current term. Switching from a monthly to a twelve-month term takes effect and is charged immediately; the twelve months begin with the switch.
(6) Either party may cancel the contract for the free Starter plan at any time in text form. We may delete Starter accounts that have not been used for more than twelve months after giving four weeks' notice.
(7) The right of both parties to terminate for good cause remains unaffected. Good cause exists for us in particular if the Agency repeatedly violates § 7 despite a warning or is more than two months in arrears with payments.
(8) If you cancel via doneforyou.io/kuendigen, we send a confirmation link to your account's email address to protect against cancellations by unauthorized persons; the cancellation is executed as soon as you confirm the link. We confirm every cancellation by email, stating the time of receipt and the date on which the contract ends. If you specify a later requested date, the contract ends at the end of the term in which that date falls.
§ 7 Obligations of the Agency
(1) You use Doneforyou only in accordance with applicable law. In particular, you ensure that
- you hold the necessary rights to all uploaded content (texts, logos, photos, videos, quotes) and that persons depicted or quoted have consented;
- job ads and landing pages are not discriminatory (in particular under the German General Equal Treatment Act, AGG) and comply with the advertising policies of the platforms used;
- every published landing page contains a correct imprint and an appropriate privacy policy of the controller;
- there is a legal basis for processing applicant data and for using a Meta Pixel, and applicants and visitors are properly informed;
- you have concluded the necessary contracts with your own clients, in particular on data processing;
- when using WhatsApp, you comply with the WhatsApp Business Terms, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy, only contact applicants first via WhatsApp if they have agreed to this, and respect opt-outs (e.g. “Stop”).
(2) It is prohibited to use Doneforyou for unlawful, misleading or discriminatory content, for spam or for purposes other than recruiting, to circumvent security measures, to scrape the software automatically or to place an excessive load on its operation.
(3) In the event of a violation, we may take the content concerned offline or temporarily block access to the extent necessary. We will inform you of this without delay.
§ 8 AI-generated content
(1) Texts, images and landing pages created with artificial intelligence are based on your information and may nevertheless be incorrect, incomplete or unsuitable. You check all results for accuracy and lawfulness before publication. You are responsible for published content.
(2) To the extent that rights arise in generated results, we grant you a simple (non-exclusive) right of use, unlimited in time and territory, which you may pass on to your clients. We give no guarantee that results are eligible for copyright protection or unique.
§ 9 Rights to content
(1) The content you upload or create in Doneforyou remains yours or your clients'. You grant us the rights we need to operate Doneforyou for you, e.g. to store and process content and display it on landing pages.
(2) In addition, upon registration you grant us a simple (non-exclusive), free-of-charge right, unlimited in time, to use this content to improve and develop Doneforyou (e.g. the quality of AI results) and to show it as examples, for instance on our website or in presentations. The following applies:
- We never use applicant data for this.
- We remove or anonymize other personal data (e.g. names, contact details, recognizable people in photos) beforehand.
- We show examples without names, logos or other features by which your agency or your client can be identified, unless you agree.
You warrant that you are entitled to grant these rights and, where necessary, obtain your clients' consent for this.
(3) All rights to the Doneforyou software and its design remain with us. For the term of the contract, you receive a simple (non-exclusive), non-transferable right to use Doneforyou as intended.
(4) Imported content. If you have a funnel or another page read via a link in order to use it in a campaign or save it as a private copy in “Inspiration”, Doneforyou takes over the content it contains, in particular texts, images, videos, logos, fonts and design. The following applies:
- Before you take over a funnel into a campaign (funnel migration), you declare that you hold the necessary rights to the funnel or are permitted to use it in this way. You make this declaration in the app by ticking a checkbox or via an AI assistant you have connected (MCP server): the assistant then shows you the wording of the declaration, and we only carry out the import after your express consent in the chat. A declaration transmitted in this way by the assistant you connected is deemed to be your declaration. We check that the wording matches the current wording and store the declaration as evidence (wording, time, account, funnel URL, technical data and, for an AI assistant, the connection); details are in the Privacy Policy.
- You alone are responsible for the rights to imported content (copyright, trademark, design, personality and competition law), including private copies in “Inspiration”, for which no separate declaration is requested. We do not check whether you hold these rights.
- A private copy in “Inspiration” is visible only to you in your account. If you wish to publish content from it, for example in a rebuild, you need the rights to do so or must replace the content with your own.
- We do not use imported content to which you do not hold your own rights under paragraph 2.
- If we have indications that imported content infringes third-party rights, in particular after notice from the rights holder, we may block, take offline or delete it. We will inform you and, where possible and reasonable, give you an opportunity to comment beforehand.
§ 10 Availability
We strive to make Doneforyou available with as little interruption as possible, but do not owe any particular availability. We carry out maintenance work during low-usage periods where possible. We are not responsible for outages caused by circumstances beyond our control (e.g. internet disruptions, disruptions at third-party providers or force majeure).
§ 11 Data protection
We process personal data of applicants, your clients and their employees on your behalf. The Data Processing Agreement, which you accept upon registration, applies to this. How we process your own data is described in our Privacy Policy.
§ 12 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent we have given a guarantee.
(2) In the case of slight negligence, we are liable only for breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract, but no more than the fees you paid to us in the twelve months preceding the event giving rise to the damage.
(3) Strict liability for defects that already existed at the time the contract was concluded (Section 536a(1), first alternative, BGB) is excluded.
(4) We are liable for loss of data only in the amount that would have been incurred had regular backups been made.
(5) These limitations also apply in favour of our employees and vicarious agents.
§ 13 Indemnification
You indemnify us against third-party claims based on a culpable violation by you or your clients of § 7 or § 9(4), e.g. due to legal infringements by uploaded, imported or published content. This also includes the reasonable costs of legal defence.
§ 14 End of contract and data
When the contract for your account ends, we delete your data and content 30 days after the end of the contract unless there is a statutory retention obligation. Until then, you may ask us to hand over your data. For applicant data and your clients' data, the Data Processing Agreement also applies.
§ 15 Changes to these Terms
We may amend these Terms with effect for the future if this is necessary due to changes in the law, case law or our service and the change is reasonable for you. We will notify you of changes in text form at least six weeks before they take effect. If you do not object before they take effect, the changes are deemed accepted; we will point this out separately in the notice. If you object, either party may terminate the contract effective as of the date the change takes effect. Changes to the main services and prices are not governed by this paragraph but require your consent or are governed by § 5(4).
§ 16 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the Agency is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered place of business.
(3) Should any provision of these Terms be invalid, the remainder of the contract remains valid.
